Court Approves Settlement with Bottomley

The Honorable Adrienne Nelson has issued an order finally approving a settlement of a class action lawsuit brought against Bottomley Evergreens alleging wage and hour violations at Bottomley’s Gresham, Oregon seasonal wreath making operation.

The class representatives alleged that Bottomley had a policy and practice of failing to pay all overtime wages due to its seasonal workers in the 2010 and 2011 wreath making seasons.

Under the terms of the settlement, eligible class members will receive a penalty of either approximately $900 or $1,800 (depending on whether the class member qualifies for one or both seasons in 2010 and 2011).  Eligible class members will also receive overtime pay and liquidated damages for all overtime hours evidenced by Bottomley’s records.

Under the settlement, 341 class members will receive payments totaling in excess of $700,000.  Payments will be made by the end of 2013.
