Josh Ross, working with a local estate planning law firm, represented the beneficiary of a family trust in a lawsuit seeking to recover over $1.5 million from the co-trustees of the trust. Our client claimed that his siblings improperly used trust money intended for his benefit to purchase property and to pay off personal debts instead of preserving the money for his health care and other needs. During litigation, opposing counsel put forward a theory that resulted in the lawyer becoming a factual witness. Ross successfully petitioned the Court to compel the lawyer to sit for a deposition, and ultimately the opposing lawyer withdrew from the case.
