Emily is an associate in the firm’s litigation group where she focuses on complex litigation matters. She was an integral part of the trial team, representing victims of the 2020 Oregon fires against PacifiCorp, in which the jury found in favor of the class after a two-month trial. Emily was also a key member of the team representing the State of Oregon in litigation against Monsanto for damages to the state’s public trust resources from PCB contamination, obtaining the largest environmental settlement in Oregon history as well as a member on the team for the City of Seattle which also obtained an environmental settlement against Monsanto. Emily is a member of the teams representing the States of Maryland and Delaware in separate PCB litigation lawsuits against Monsanto.

In 2024, Emily received the Oregon Trial Lawyers Association (OTLA) New Lawyer of the Year award recognizing her involvement in OTLA and her work representing victims of the 2020 Oregon Labor Day Fires against Berkshire Hathaway’s PacifiCorp. Emily is an OTLA board member and is involved in several sections and committees, including the New Lawyer Section, Membership Committee, Legislative Committee, and Publications Committee as well as serving on the board of governors. She is an alumni of OTLA’s leadership academy.

Prior to joining Stoll Berne, Emily was an Associate Attorney for another Portland law firm where she practiced personal injury litigation. She served as a law clerk in the Civil Enforcement Division – Financial Fraud & Consumer Protection for the Oregon Department of Justice. Working in the Civil Enforcement Division – Finance Fraud & Consumer Protection, Emily focused on Oregon’s Unlawful Trade Practices Act violations, civil investigative demands, and settlement proposals.

While attending Northwestern School of Law, Lewis & Clark Law College, Emily served as a Research Assistant where she researched bankruptcy law. She served as the Executive Editor and member for the Lewis & Clark Law Review and was a member of the Animal Law Review where she was named Source Checker of the Year. While attending the University of Washington, Emily studied abroad in Linköping, Sweden.

$84 Million Award After Jury Trial to Nine Victims of Labor Day 2020 Fires in First PacifiCorp Damages-Only Trial

A jury in Portland, Oregon awarded approximately $62 million in compensation to be paid by PacifiCorp to nine survivors of the fires that swept across Oregon during the Labor Day 2020 storm. We were co-lead counsel for the plaintiffs at the trial.

James et al. v. PacifiCorp et al.

This case is a certified issues class action arising from the 2020 Labor Day fires in Oregon. Former Oregon Governor Kate Brown described the fires as possibly the greatest loss of life and property from wildfire in Oregon’s history.

Maui, Hawai’i Fire

During a forecasted windstorm, when the fire danger was extreme, the power company on Maui left its power lines energized. The power lines ignited several fires and caused massive devastation to Lahaina and other communities.

Oregon Securities Class Action

Portland Development Group Investments, LLC.  The investors alleged that the seller falsely inflated its financial statements that were published in its offering documents, and that the seller’s accounting firm, lawyers, and others were liable for aiding and assisting the securities sales. 

Natural Resource Damage and Environmental Contamination

As Special Assistant Attorneys General for the State of Oregon, Stoll Berne, along with co-counsel Keller Rohrback, worked with Attorney General Ellen Rosenblum and attorneys from the Oregon Department of Justice on claims against Monsanto seeking recovery for damage caused to Oregon’s wildlife and environment by polychlorinated biphenyls (PCBs).

Jury Awards Labor Day 2020 Fire Victims Another $42.4 Million in Damages Against PacifiCorp

A third jury in Portland, Oregon has awarded more than $42 million in compensation to ten survivors of the wildfires on Labor Day 2020. The total award to the ten plaintiffs is $42,412,119.00, consisting of $5.933 million in economic damages (which are doubled) and $23.25 million in non-economic damages, both of which are increased by 25% for punitive damages.

Stoll Berne and Keller Rohrback defeat Monsanto’s Motion for Summary Judgment in PCB Contamination Lawsuit

On February 2, 2024, the U.S. District Court for the Western District of Washington denied Monsanto’s Motion for Summary Judgment in ongoing PCB litigation. Stoll Berne and co-counsel at Keller Rohrback represent the City of Seattle in this suit and seek to hold Monsanto accountable for the harms that Monsanto’s PCBs have caused to the City’s stormwater and drainage system and the Lower Duwamish Waterway.

Portland Jury Awards $85 Million Judgment to 9 Victims of Labor Day 2020 Fires in First PacifiCorp Damage Phase Trials

A jury in Portland, Oregon awarded $85 million in compensation from PacifiCorp to nine survivors of the fires that swept across Oregon on Labor Day 2020. The verdict, which consisted of more than $6 million in economic and $56 million in non-economic damages, translates to an award of more than $85 million after the doubling of economic damages and the addition of punitive damages of 25% that are automatically applied given the jury’s verdict in the first phase of the case.
