Robert Shlachter

Rob is an accomplished mediator, arbitrator, and trial lawyer emphasizing all types of complex business litigation, including intellectual property, unfair competition, and real estate litigation.

In 2009, Rob was inducted into the American College of Trial Lawyers. He is the former president of the Association of Business Trial Lawyers and frequently lectures and writes about strategies in mediation and litigation. Rob is widely regarded as one of the preeminent mediators, arbitrators, and litigators in Oregon, and has acted as an official and unofficial mentor to countless lawyers, both inside and outside of the firm. Chambers USA, in 2022, ranked Rob in their Spotlight Table under “Oregon Litigation: Mediators,” one of only six attorneys ranked in the state. Rob models professionalism in every facet of his practice and consistently aims to meet the highest standards of client service. In 2018, Rob received the Oregon State Bar’s 21st Annual Owen M. Panner Professionalism Award which recognizes both personal and professional qualities, reputation, and conduct.

Stoll Berne attorney Rob Shlachter represented Med-Tech Resource, LLC, a Eugene-based distributor of medical and safety equipment and supplies, in a lawsuit brought by a former employee who sought up to $1 million in damages based on an alleged oral partnership agreement between plaintiff and the client.

Starlite Aviation vs. Erickson Helicopters

Rob Shlachter and Tim DeJong obtained a preliminary injunction preventing a prime government contractor from terminating a multi-million-dollar contract for supply of helicopters in Afghanistan.

Insurance Coverage Disputes

On many occasions, the firm has successfully obtained tens of millions of dollars of insurance coverage under disputed D&O policies. 

Defense of Conflict of Interest & Participation in Fraudulent Conveyances

Rob Shlachter successfully defended the CEO of the Portland Trail Blazers, who was accused of engaging in conflicts of interest and participating in fraudulent conveyances.

Blue-Green Algae Contract Dispute

Rob Shlachter and Steve Berman successfully defended Klamath Algae Products in a three-week jury trial, one of the longest civil jury trials in Klamath County history.

Breach of Contract Dispute

Rob Shlachter and Josh Ross represented a European manufacturer of fiber optic equipment in a contract dispute with a third-party company who refused to supply certain agreed-upon technology.

Hostile Take-Over in Fitness Industry

Rob Shlachter and Tim DeJong successfully represented CrossFit, Inc. in an attempted hostile take-over by Anthos Capital, L.P.

Multi-Party Negotiations and Litigation on Behalf of Real Estate Developer

Rob Shlachter successfully represented a major Portland-based real estate management, development, and investment firm in complex multi-party negotiations and litigation related to the client’s rights with respect to a portfolio of medical office buildings located across the country.

Representation of Sports Memorabilia Manufacturer

The firm defended GameWear, Inc., a sports memorabilia manufacturer, against claims of breach of contract, trade libel, and intentional interference with economic relations.

Breach of Contract Against Gasoline Wholesaler

Following a five-day arbitration hearing, Rob Shlachter obtained a monetary award and injunctive relief on behalf of a retail gas station operator in a breach of contract action against a gasoline wholesaler involving a supply contract.

Rob Shlachter and Josh Ross defended a Portland real estate investment firm in litigation filed by a large group of investors.

United States Golf Association Representation

Rob Shlachter defended the United States Golf Association in an action brought by an amateur golfer alleging breach of contract, breach of duty of good faith and fair dealing, and statutory violations arising out of the USGA's decision to rescind the golfer's amateur status.

Advancement Rights Under Delaware Indemnification Law

Rob Shlachter and Tim DeJong won two arbitrations establishing advancement rights for attorney’s fees worth more than $5 million under Delaware indemnification law.

Clothing Manufacturer Fraud Litigation

Rob Shlachter acted as co-lead counsel in two jury trials in California (one on fraud and one on fiduciary duty and damages) for owners of a major clothing manufacturer against partners.

Rob Shlachter and Tim DeJong successfully represented a manufacturer of backup power fuel cell products in a patent infringement lawsuit relating to the client’s patented integrated hydrogen generator systems.
